WolfPaw Antifraud — Terms of Use

Agreement

These Terms of Use ("Terms") govern your access to and use of wolfpaw-antifraud.com (the "Site") and the fraud screening software products (the "Products") offered by WolfPaw Hosting and Development LLC ("WolfPaw," "we," "us," or "our"). By accessing the Site or using any Product, you agree to be bound by these Terms. If you do not agree, do not use the Site or Products.

These Terms apply in addition to any terms imposed by the marketplace through which you purchased a Product (WooCommerce Marketplace, Adobe Commerce Marketplace, Miva Apps, or our direct store). In the event of a conflict, marketplace terms govern the purchase and these Terms govern the use of the Product.

1. Nature of the Products

WolfPaw Antifraud products are screening tools that assist merchants with fraud detection by integrating third-party risk scoring services (MaxMind minFraud). The Products are designed to help merchants identify potentially fraudulent orders, but they are not a guarantee of fraud prevention or detection.

Important: The Products do not ensure, guarantee, or warrant that all fraudulent transactions will be detected or that all legitimate transactions will be approved. Fraud screening involves probabilistic risk assessment. False positives (legitimate orders incorrectly flagged) and false negatives (fraudulent orders not detected) can and will occur. The merchant is solely responsible for all final decisions regarding order acceptance or rejection.

2. Third-Party Services

The Products integrate with MaxMind's minFraud service for fraud risk scoring. Your use of MaxMind's service is subject to MaxMind's Terms of Use. WolfPaw is not responsible for the accuracy, availability, or performance of MaxMind's service. Risk scores are generated by MaxMind based on their proprietary algorithms and data; WolfPaw does not control or influence how risk scores are calculated.

3. Disclaimer of Warranties

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WOLFPAW DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT
•
WARRANTIES THAT THE PRODUCTS WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS
•
WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY RISK SCORES, SCREENING RESULTS, OR OTHER OUTPUT
•
WARRANTIES THAT THE PRODUCTS WILL DETECT ALL FRAUDULENT TRANSACTIONS OR CORRECTLY CLASSIFY ALL LEGITIMATE TRANSACTIONS

The Products may contain technical inaccuracies. Risk scoring is inherently probabilistic and depends on the quality and completeness of data provided by MaxMind and by the merchant's e-commerce platform. WolfPaw does not represent or warrant that screening results are accurate, complete, or current.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WOLFPAW AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR PRODUCTS, INCLUDING BUT NOT LIMITED TO:

DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES
•
LOST PROFITS, LOST REVENUE, OR LOST BUSINESS OPPORTUNITIES
•
CHARGEBACKS, FRAUDULENT TRANSACTIONS, OR PAYMENT PROCESSING FEES RESULTING FROM ORDERS THAT WERE NOT DETECTED AS FRAUDULENT
•
LOST SALES OR CUSTOMER RELATIONSHIPS RESULTING FROM ORDERS THAT WERE INCORRECTLY DECLINED
•
DAMAGES ARISING FROM ERRORS, OMISSIONS, OR INTERRUPTIONS IN THE PRODUCTS OR THIRD-PARTY SERVICES

IN NO EVENT SHALL WOLFPAW'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

This limitation applies even if WolfPaw has been advised of the possibility of such damages and regardless of whether the claim is based on contract, tort, negligence, strict liability, or any other legal theory.

5. Merchant Responsibilities

By using the Products, you acknowledge and agree that:

You are solely responsible for configuring risk thresholds, decline settings, and all other Product settings appropriate for your business
•
You are solely responsible for all decisions regarding order acceptance or rejection
•
The Products assist with fraud detection but do not replace a comprehensive fraud prevention program
•
You are responsible for maintaining your MaxMind account, query credits, and API credentials
•
You are responsible for compliance with all applicable laws and regulations, including GDPR, CCPA, PCI DSS, and any industry-specific requirements
•
You will provide appropriate privacy notices to your customers regarding the collection and processing of their data for fraud screening purposes

6. Intellectual Property

All content on this Site and within the Products, including text, images, graphics, logos, software, and documentation, is the property of WolfPaw or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not modify, copy, distribute, reverse engineer, decompile, or create derivative works from the Products without our prior written permission.

7. Indemnification

You agree to indemnify, defend, and hold harmless WolfPaw and its officers, directors, employees, and agents from any claims, damages, losses, costs, and expenses (including attorneys' fees) arising from your use of the Site or Products, your violation of these Terms, or your violation of any applicable law or regulation.

8. Termination

We may terminate or suspend your access to the Site or Products at any time, with or without cause and without liability. Upon termination, all provisions of these Terms that by their nature should survive will survive, including disclaimers, limitations of liability, and indemnification.

9. Governing Law

These Terms are governed by the laws of the State of New Jersey without regard to conflict of laws principles. You consent to the exclusive jurisdiction of the state and federal courts located in New Jersey.

10. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision does not constitute a waiver.

11. Changes

We may update these Terms at any time by posting a revised version. Changes are effective when posted. Your continued use of the Site or Products constitutes acceptance of any changes.
